SOOK Vinyl & Vintage - Terms of Service

Welcome to SOOK Vinyl & Vintage! These Terms of Service ("Terms") govern your access to and use of our website, physical store, products, and services (collectively, the "Services"). By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the Services.

1. Acceptance of Terms

By Browse our website, making a purchase in our physical store, or otherwise utilizing our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our Services following the posting of any changes constitutes acceptance of those changes.

 

2. Products and Services

  • Product Descriptions: We strive to be as accurate as possible in the descriptions of products displayed on our website and in-store. However, we do not warrant that product descriptions or other content of our Services are entirely accurate, complete, reliable, current, or error-free. If a product offered by SOOK Vinyl & Vintage itself is not as described, your sole remedy is to return it in unused condition, subject to our return policy.

  • Availability: All products are subject to availability. We reserve the right to limit the quantities of any products or services that we offer. We also reserve the right to discontinue any product at any time.

  • Used Records: For used records, we provide a grading system to describe the condition of the vinyl and sleeve. This grading is subjective and based on generally accepted industry standards (e.g., Goldmine Standard). We make every effort to grade accurately, but minor variations or personal interpretations may occur. Used records are sold "as is" with their described imperfections.

  • Pricing: All prices are listed in USD and are subject to change without notice. While we strive for accuracy, errors in pricing may occur. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price.

3. Orders and Payment

  • Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

  • Payment: We accept various forms of payment, as indicated in-store or on our website. All payments must be received in full before an order is processed or goods are released.

  • Sales Tax: Applicable sales tax will be added to your order where required by law.

4. Shipping and Delivery (for online purchases)

  • Shipping Costs: Shipping costs are calculated based on the weight, dimensions, and destination of your order and will be displayed at checkout.

  • Delivery Estimates: Estimated delivery times are provided for your convenience but are not guaranteed. We are not responsible for delays caused by shipping carriers or unforeseen circumstances.

  • Risk of Loss: The risk of loss and title for items purchased from SOOK Vinyl & Vintage pass to you upon our delivery to the carrier.

5. Returns, Refunds, and Exchanges

  • General Policy: We want you to be happy with your purchase. You may return most new, unopened items within 30 days of purchase for a refund or exchange.

  • Conditions for Returns:

    • Items must be in their original, unopened condition (e.g., sealed records must remain sealed).

    • Proof of purchase (receipt or order number) is required.

    • Returns of used records are generally accepted only if there is a significant discrepancy between the stated grade and the actual condition, or if the record is unplayable due to a defect not noted.

  • Non-Returnable Items: The following items are typically not eligible for return:

    • Opened new records (unless defective).

    • Gift cards.

    • Clearance or "final sale" items.

    • Items damaged due to misuse or neglect.

  • Refund Process: Refunds will be processed to the original method of payment within 5-10 business days after the returned item is received and inspected. Shipping costs are non-refundable.

  • Defective Items: If you receive a defective item, please contact us immediately to arrange for a return or exchange.

6. Intellectual Property

All content included in or made available through our Services, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of SOOK Vinyl & Vintage or its content suppliers and protected by United States and international copyright laws. The compilation of all content included in or made available through our Services is the exclusive property of SOOK Vinyl & Vintage and protected by U.S. and international copyright laws.

7. User Conduct

You agree not to use the Services for any unlawful purpose or in any way that might harm, defame, or otherwise injure SOOK Vinyl & Vintage, its employees, or other users. Prohibited activities include, but are not limited to:

  • Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.

  • Attempting to gain unauthorized access to any portion or feature of the Services.

  • Introducing any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

8. Disclaimer of Warranties; Limitation of Liability

THE SERVICES AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICES ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

IN NO CASE SHALL SOOK VINYL & VINTAGE, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless SOOK Vinyl & Vintage and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

10. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

11. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Pennsylvania, United States, without regard to its conflict of law principles.
